Whole Milk for Healthy Kids Act

Yesterday, President Trump signed into law the Whole Milk for Healthy Kids Act of 2025. This law amends the Richard B. Russell National School Lunch Act.


The change allows whole milk to be served in schools, along with reduced-fat, low-fat, and fat-free flavored and unflavored milk. It can be organic or not organic. This bill also allows for parents to provide a written statement for a milk substitute. Previously, it was only allowed by a written statement from a licensed physician. It also removes the fat content from milk in the minimum requirement of saturated fats in school meals.


How does this relate to CACFP?

Currently, this change in the National School Lunch Act does not impact CACFP. The sections in the law that talk about CACFP have not been changed.


There is one caveat: if you are a CACFP operator that is allowed to follow the NSLP meal pattern, based on your operations, it could impact those operations.


The next step in this process is for USDA to write a proposed regulation and put out guidance through memos and Q&As for how schools should implement this new law. At this time, it could be possible, according to experts and advocates, for USDA to provide guidance or best practices to states that enfold CACFP, but we won't know what that looks like until when/if it happens.


We'll keep tabs on this and keep you posted. There are no changes in CACFP as of yet.
